(1)CARGO DOCUMENTS Cargo Documents (Bs/l and freighted manifests) must be presented to Ecuadorian local Authorities via electronic 48 hrs prior vessels arrival and 24 hrs for cargoes loaded at near Ports like : Callao, Pe, Buenaventura,Col, Panamà, Kingston,Ja, exceptions will be accepted only for cargoes coming from Paita,Pe, which should be presented 12 hrs before vessels arrival. The lack of documents / information via electronic will be consider as a Custom violation based on Art 83, the Free Platique of the vessel wont be authorized and the Cargo discharged and not declared via electronic will be confiscated by Customs. (2)ORIGINAL + NON NEGOTIABLE COPIES It is imperative to include the total freight into original bs/l for Customs certification purposes only. Non Negotiable copies must be issued in the same tenor as the original B/l released to the customer.
The Customs Law in force establish as Custom violation the discrepancies between non negotiable copies and originals, therefore the clearance of the cargo wont be authorized until the differences are duly clarified and against the payment of a Custom Penalty.
According to last Regulation No. 348, all vessels calling to Ecuador from August 1st/01, must have the Consignee’s R.U.C., ID number or passport number indicated in Bills of Lading and Cargo Documentation as follows:
(a)Ecuador Tax contributor Unique Register (R.U.C) if the consignee is a company (b)Ecuador ID number if the importer is and Ecuadorian natural person (c)Passport number if the importer is other than Ecuadorian (d)If the cargo is consigned to THE ORDER, the notify’s RUC, ID number or passport number must be indicated.
Please note that in order to comply with the new procedures regarding the International Ships and Port Facilities Code (ISPS) and to fulfill what is reported in the PSPP ( Port Public Security Plan), it is extremely important that from now on, all bills of lading /cargo manifest must declare the real and exact gross weight / Net weight in KILOS, quantity of packages PER CONTAINER and measurements in cubic meters for all import cargoes coming to Ecuador, including Break Bulk cargoes. Temperature Range and Imo codes for dangerous cargo must be included into bs/l and cargo /freight manifests. Descriptions of cargoes will be accepted in English with a short description in Spanish. Customs Authority do not accept any type of amendment, scribbled and crossed out on ORIGINAL BS/L, either with an alteration approved stamp from the loading agency. The date of issuance of the b/l and the vessels sailing date must be declared/included into original bs/l and non negotiable copies presented by the local Agency to Customs . Up to two (2) different currencies will be accepted by Customs, but including into freight manifest the proper Rate of Exchange (ROE) to US DOLLARS at time of loading. (3)CORRECTION NOTES (FREIGHT & CARGO MANIFEST)
Amendments will be accepted up to 48 hrs before vessels arrival to any Ecuadorian Port, after that period of time, will be subject to fine of USD 130,00 per B/L. Correction request can be introduced after the payment of the Customs Penalty and same will be subject to the Customs s approval, analysis and consideration of all cargo documents. New and correct set of clean originals (3/3), should be printed at loading port or locally which will cost USD 30,00 for the issuance of the second set.
It is imperative for the local agency to receive the corresponding Correction Note stating into the “Remarks field” who is the responsible party for the amendment

In case of Intermodal Shipments, changes to the vessels name due to a transshipment will be an exception accepted by Customs, but must be justified by an official letter issued by the local agency. Status of Container and the place where the cargo will be stored, could be changed only prior physical inspection of the merchandise and will be subject to Custom Penalty. (4)SHIPMENTS ON COLLECT BASIS
Will be accepted only with the previous advice in order to contact Consignee or Notify party in order to obtain written agreement for FOB shipments.
(5)CONSULAR DOCUMENTS
Only the ships documents must be legalized.
(6)IN TRANSIT CARGO MANIFEST
No manifest for cargoes in transit (that wont be discharged at Gye), must be presented via electronic to Customs.
Will be necessary only if the Authority required same to the master of the vessel by the Free Platique.
(7)DANGEROUS CARGO MANIFEST
In view of the new procedures regarding the International Ships and Port Facilities Security Code (ISPS – Code), and in agreement with the Resolution no. 2 of the Dipolomatic Conference on Maritime Protection in the scope of the IMO dated December 2002, the Dangerous Manifest / Intermodal Reports, must be presented 72 hrs prior vessels arrival to the local port authorities, for cargoes coming to any Ecuadorian Port or for cargoes in transit.
(8)TEMPERATURE LETTERS FOR REEFER CARGOES
Must be received prior vessels arrival for the monitoring of the containers to be discharged at our Port.
(9)PROCEDURES FOR TRANSHIPMENT CARGOES
It takes 36 to 48 hrs to finish a t/s procedure, and same must be presented to Customs indicating the name of the intended t/s vessel, max. 24hrs after the departure of discharge vessel, otherwise local agency will be subject to Customs fine.
(10)CONSOLIDATED CARGOES :
The Master bill of Lading must include all the details mentioned into the House bills of lading like : Marks and Numbers, Quantity of Packages and Number of house b/l. The total ocean freight of the Master Bill of Lading can’t be higher than the value declared into the House bills of lading presented by the NVOCC companies. Ecuadorian Customs System will detect when is erroneously declared and will reject the clearance of the cargo.
(11)The new Customs System called SICE which is functioning since July 29th/02 for all the Foreign Trade Operators do not permit to the SHIPPING AGENCIES to manifest one container on FCL/FCL condition, split n two or more bills of lading consigned to different companies.
Container must be declared on FCL/LCL status otherwise Customs System will reject the electronic transmission and container can not be discharged.
(12)DOUBLE CONSIGNMENT
Its not acceptable by Custom Authorities, the double consignment as per following detail : Consignee:

Have to remind you that the import permit is opened before shipment by one of the importers, therefore the correct full style of the Consignee including the corresponding RUC NUMBER and or Passport Number must be declared. (13)please be informed that according to resolution of Servicio Ecuatoriano de Sanidad Agropecuaria. (SESA), has been determined that as of December 17th, 2005, woods used to package cargo to Ecuador or in transit to third countries, shall be manufactured with wood treated in the last origin country.

Natural woods must receive Thermic treatment (HT) or be fumigated with methyl bromide (MB) and shall have the following permanent mark on, at least, two sides of the packing, as evidence of its treatment. Marks shall not be red or orange, colors used to identify dangerous cargoes.
Manufactured woods, made by mechanical process, like ply-woods, agglomerate, etc, are exempt of this regulation. (INS032/2004 & INS048/2005)
